Waiver & Release of Liability

PARENTAL/GUARDIAN CONSENT, INDEMNITY & MEDICAL AUTHORIZATION

1.  PARTIES AND ACKNOWLEDGEMENT

This Waiver and Release of Liability (the “Agreement”) is entered into by the parent or legal guardian (“Parent/Guardian”) who has indicated acceptance of this Agreement by checking the confirmation checkbox during the online registration process on behalf of the minor participant named (“Participant”), in favour of Power Hockey Academy, its owners, directors, officers, coaches, volunteers, staff, and agents; the arena facility and its owners, operators, and staff; and any program sponsors (all of the foregoing collectively referred to as the “Releasees”).

The Parent/Guardian confirms that the Participant is under 18 years of age and that the Parent/Guardian has full legal authority to execute this Agreement on the Participant’s behalf.

2.  NATURE OF ACTIVITY AND INHERENT RISKS

Ice hockey is a physically demanding sport that involves inherent and unavoidable risks, including but not limited to:

  • Collisions with other players, boards, goal posts, and ice surfaces;
  • Injuries from hockey sticks, pucks, and skate blades;
  • Sprains, strains, fractures, concussions, and other serious physical injuries;
  • Exposure to cold temperatures and related conditions;
  • Equipment failure or malfunction;
  • Physical contact with other participants, including injuries to the eyes, teeth, face, and head, as well as spinal cord injuries which may result in permanent paralysis;
  • Variations in ice surface conditions;
  • Travel to and from camp sessions, tournaments, off-site training, and any other activities that form part of the PHA program;
  • Any other risks inherent in on-ice or off-ice training activities.

The Parent/Guardian acknowledges that these risks cannot be entirely eliminated and accepts them on behalf of the Participant. The Parent/Guardian further acknowledges that: the risk of injury increases as the Participant becomes fatigued; the risk of injury is reduced by following all rules and coach instructions; injuries sustained in ice hockey can be severe, including permanent disability; and the Participant may experience anxiety or psychological stress during challenging drills or competitive activities. PHA staff are not licensed mental health professionals and are not responsible for providing psychological support or counselling.

3.  ASSUMPTION OF RISK

The Parent/Guardian, on behalf of the Participant, voluntarily and knowingly assumes all risks of injury, illness, loss, or damage arising from the Participant’s participation in any Power Hockey Academy camp, program, training session, or related activity, whether or not caused by the negligence of the Releasees.

4.  WAIVER AND RELEASE OF LIABILITY

In consideration of PHA permitting the Participant to attend and participate in camp activities, the Parent/Guardian, for themselves and on behalf of the Participant, their heirs, executors, administrators, and assigns, hereby:

  • WAIVES any and all claims against the Releasees arising from the Participant’s participation in camp activities, including claims arising from the negligence of the Releasees;
  • RELEASES AND DISCHARGES the Releasees from any and all liability for personal injury, property damage, or financial loss suffered by the Participant, including claims arising from negligence, breach of contract, breach of statutory duty of care, or breach of applicable occupiers’ liability legislation;
  • AGREES not to make or bring any claim, action, or proceeding against PHA in connection with such injury, loss, or damage.

5.  INDEMNIFICATION

The Parent/Guardian agrees to indemnify and hold harmless the Releasees from and against any claims, demands, costs, and expenses (including legal fees) arising out of or related to the Participant’s conduct, participation in camp activities, or any breach of this Agreement.

6.  MEDICAL AUTHORIZATION

In the event of illness, injury, or medical emergency, and where the Parent/Guardian cannot be reached in a timely manner, the Parent/Guardian hereby authorizes PHA staff to:

  • Seek immediate emergency medical attention for the Participant;
  • Consent to necessary medical treatment, including hospitalization, surgery, or the administration of medication as deemed appropriate by medical professionals;
  • Transport the Participant to the nearest appropriate medical facility.

The Parent/Guardian agrees to be responsible for all medical expenses incurred on the Participant’s behalf. PHA strongly recommends that all participants maintain adequate personal health and accident insurance.

The Parent/Guardian further authorizes designated PHA staff to assist the Participant in the self-administration of their own prescribed medications (including but not limited to inhalers, EpiPens, and daily prescription medications) in accordance with written instructions provided by the Parent/Guardian at the time of registration. The Parent/Guardian agrees to: (a) disclose all medications the Participant requires during camp activities; (b) provide the medications in clearly labelled original packaging; and (c) provide written administration instructions. The Parent/Guardian acknowledges that PHA staff are not medical professionals and will rely solely on the information provided by the Parent/Guardian. PHA accepts no liability for adverse reactions arising from the administration of medications in accordance with such instructions.

7.  RULES, CONDUCT, AND EQUIPMENT

The Parent/Guardian agrees that the Participant will:

  • Comply with all PHA rules, coach instructions, and facility regulations at all times;
  • Wear all required and recommended protective equipment during on-ice activities;
  • Behave respectfully toward coaches, staff, and fellow participants;
  • Refrain from engaging in reckless, dangerous, or unsportsmanlike conduct.

PHA reserves the right to remove any participant from the program without refund if their conduct endangers others or is deemed unsuitable by camp staff.

8.  PHOTOGRAPHY AND MEDIA CONSENT

By signing this Agreement, the Parent/Guardian consents to PHA photographing or recording the Participant during camp activities for use in promotional, educational, and social media materials, including but not limited to Instagram, Facebook, YouTube, TikTok and the PHA website, without compensation. If you do not consent, please notify PHA in writing prior to the camp start date at registration@powerhockeyacademy.com.

9.  GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties submit to the exclusive jurisdiction of the courts of Ontario.

10. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior discussions.

ACKNOWLEDGEMENT OF UNDERSTANDING

By checking the confirmation checkbox during registration, the Parent/Guardian confirms that:

  • They have read and understood this Agreement in its entirety;
  • They have had the opportunity to seek independent legal advice;
  • They are the parent or legal guardian of the Participant named below;
  • They agree to all terms of this Agreement on behalf of themselves and the Participant.
